5 The Laws and the Concepts of Human Rights inthe ANE Law Books and in Deuteronomy

In the previous three chapters, this study has presented distinctive humanitarian concerns in the biblical slave laws, which are beyond comparison. This chapter will discuss the possible rationales behind the laws that led to these differences between the biblical and the ANE laws. Then, according to the understanding of the rationales behind the laws, this chapter will illustrate the concept of human rights in Deuteronomy. In view of that, the first step will examine the different cosmologies between the Bible and the ANE based on J. J. Finkelstein’s study.651 The second step will seek to understand the different worldviews presented in the biblical and the ANE law books. This examination will apply P. G. Hiebert’s definition of worldview in the three dimensions: cognitive, affective, and evaluative.652 The third comparative study will employ E. Fox-Decent’s theory to understand the different positions of morality shaping in laws held by the biblical and ANE laws.653 This comparison will focus on the book of Deuteronomy and the ANE law collections with a tripartite presentation,654 given that the presentation also expresses its lawgiver’s attitude toward humanitarian concerns. The final section of this chapter then will depict the concept of human rights in Deuteronomy and answer the question of whether God is a necessary figure in respecting and protecting human rights.
